According to Decree 115/2018 / ND-CP on sanctioning administrative sanctions for food safety, the main sanction is fine and no warning. Increase the fine in behavior, up to 7 times the value of infringing goods (previously only 3.5 times).
For example, the use of animals not under veterinary hygiene inspection for food production and processing instead of fines is 80-100% of the total value, up to 2 times and removed the ceiling of 100 million . The fine of VND 80-100 million for the use of banned chemicals is VND70 million.
The new Decree also provides for many additional sanctions such as deprivation of the right to use the certificate of food safety eligibility, the declaration of acceptance of a product declaration. In addition, the establishment shall be suspended from operation for a definite period, confiscating material evidences of violation.
The violating organization shall also be forced to revoke its self-declaration of products, destroy food and bear all expenses for the treatment of food poisoning. The decree added post-inspection regulations to suit the way of food management, moving from pre-inspection to post-inspection.
The decree takes effect on October 20, replacing the old decree promulgated in 2013.
