Under the Law on Environmental Protection 2020, an EIA is defined as “the process of analyzing, evaluating, identifying, and forecasting environmental impacts of an investment project and proposing measures to minimize adverse environmental effects.”

Legal Basis

• Projects subject to EIA: Per Article 30 of the Law on Environmental Protection 2020, EIAs are mandatory for:
• Group I Investment Projects: Projects with a high risk of large-scale environmental pollution; projects with environmentally sensitive factors; or projects requiring large-scale land clearance and resettlement.
• Group II Investment Projects: Projects with a medium risk of pollution; projects using medium-scale land or sea areas, or those involving environmentally sensitive factors.

Timeline: EIAs must be conducted concurrently with the preparation of the Feasibility Study (FS) or equivalent documentation (Clause 1, Article 31, Law on Environmental Protection 2020).
